CONTRACT CONDITIONS

This agreement regulates the general conditions of purchase of the various products and services offered on this website by ALNA, S.A. (hereinafter ALNA), with NIF number A17025826 and registered office at c/ Gelpi 6 of (17210) Calella de Palafrugell (Girona, Spain).

By completing the registration process and purchasing of any of our products, the CLIENT expressly accepts and submits to the specific clauses below, together with the conditions on accessing and using our portal and its privacy policy, available via the  “Privacy Policy” link.

The CLIENT affirms they have sufficient legal capacity to be contractually bound.

This contract is available at all times in the legal notices on our webpage.

  1. PRICES AND TAXES

In consideration for the product acquired, the CLIENT expressly accepts to pay to ALNA at the time of purchase the sums specified on the price list shown on the website https://www.poseidoncalella.com/ for the chosen products.

The products offered on this website are subject to Value Added Tax (VAT), which is INCLUDED in the prices listed for each product.

Once the products have been selected and before the order is confirmed and payment is made, the final purchase price will appear on the screen, which includes the VAT (Value Added Tax), handling, packaging and shipping expenses, if any, which will be shown on the purchase order at the time of purchase and on the bill.

It does not include any item not specified as included in the description .

  1. PURCHASING PROCEDURE

Orders may only be placed on this webpage by individuals aged over 14 and by companies.

The webpage describes all our products individually. The procedure for making and handling the purchase is shown on the webpage, just by following the steps below:

  1. Choose the desired product.
  2. When you select a product it can be added to the Shopping Cart and you can then continue shopping or process the order.
  3. To process the order you must fill in a form with your personal details to formalise the purchase procedure.
  4. The order showing the articles selected one by one will then be checked and the total price calculated.
  5. It is also necessary to provide an address for billing the purchase.
  6. Once this process is complete, it is necessary to check the box indicating that the terms and conditions of sale have been read and accepted.
  7. The webpage shows the systems available for making payment in accordance with the chosen method.
  8. Once the payment details have been entered, the client must confirm the order by pressing the “Purchase” button.
  9. Once the “Purchase” button is clicked, the ordered product/service will be sent by e-mail.

  1. AVAILABILITY AND DELIVERY

The products offered by ALNA are available for sale anywhere in the world and for delivery on the dates and locations indicated in the description of each activity or service on the website. Some of the services, products and activities offered by ALNA cannot be booked and contracted through the website; they are services that are contracted via telephone and paid in person; these services will be clearly identified on the website.

Orders will be processed once payment is received correctly.

To keep you informed at all times about the handling of the purchase, you will receive an email confirming the order and payment.

ALNA reserves the right to cancel any reservation due to weather conditions, as all activities and services offered must be provided within specific weather conditions. In the event of a cancellation by ALNA due to weather conditions, the CLIENT will be offered a change of date free of charge or a full refund of any amounts paid.

  1. PAYMENT AND PAYMENT PERIODS

The following forms of payment are accepted:

Credit and Debit Card through STRIPE: through Stripe’s secure payment gateway.

Paypal: By connecting directly with Paypal.

Bank transfer: by depositing the total amount of the purchase in the current account shown.

Once payment is made you will receive a confirmation email.

ALNA will be unaware of your credit card details. All our payment systems are fully secure.

Payment are prior to delivery of the product or provision of the service and therefore ALNA will not supply the product ordered until such time as it has received payment of same. ALNA reserves the right to temporarily or definitively cancel the services rendered due to any incident relating to payment of same.

  1. INVOICES

Upon making payment, and if the CLIENT expressly requests it, they will receive the Invoice for the purchase in PDF format at the email address provided when processing the order. The CLIENT can request the electronic or paper invoice by leaving a comment on the order or by contacting info@poseidoncalella.com. Should the CLIENT require an invoice in the name of their company, they must contact the customer care service at the above email to provide the necessary tax details.

The CLIENT is responsible for confirming receipt of any notifications and informing us of any modification to their details, and ALNA will accept no liability due to this circumstance.

  1. WARRANTY

At ALNA  we strive to offer services of the highest quality although, given the nature of same, we cannot offer guaranteed satisfaction. Should you fail to receive the product or service correctly for any reason, you should inform us as soon as possible, describing the incident which, after verifying the error, we will remedy as soon as possible.

  1. REFUNDS

Given the nature of the service referred to herein, no refunds are possible.

Even so, ALNA has a Refund Policy for certain high-cost services such that, if the requirements are met, ALNA will refund a part of the payment; this refund will be proportional and will depend on each specific case. The CLIENT may request more detailed information about ALNA’s Refund Policy by contacting info@poseidoncalella.com to verify if it covers the service he/she wants to hire and how it affects the service he/she wants to hire.

  1. RIGHT OF WITHDRAWAL

In accordance with the provisions of the Royal Legislative Decree 103, of November 16/2007, 2007, on the Defence of Consumers and Users, we inform you that the right of withdrawal shall not apply to the supply of services related to leisure activities, if the contracts provide for a specific date or period of performance. Therefore, the right of withdrawal for the services offered on this website does not apply.

  1. PERFECTION OF CONTRACT AND MODIFICATION OF SERVICES

The present contract will be perfected with the payment of the product.

ALNA reserves the right to modify any of the characteristics and conditions of its services to improve them in any manner to the benefit of the CLIENT.

  1. OBLIGATIONS OF THE PARTIES

ALNA undertakes to supply the CLIENT with the products and services acquired, using due diligence in providing the service and safeguarding the necessary facilities for the operation of the network, for which purpose it has adequate technical and IT equipment.

The CLIENT undertakes to use the services placed at their disposal in good faith, without infringing any laws or third-party rights and to pay for the product selected in the manner and at the time set forth in these contract conditions.

ALNA does not warrant that the availability of the service referred to herein is continuous or uninterrupted due to circumstances originating as a result of Internet issues, breakdown of IT devices or other unforeseeable circumstances. The CLIENT therefore accepts to tolerate these circumstances within reasonable limits and expressly waives any claim against ALNA for any contractual or extra-contractual liability for any failures, errors or use of the service engaged.

  1. NOTICES

All and any notices between the parties shall be preferably via email. The CLIENT is responsible for confirming receipt of any notices and informing ALNA of any modification to their details, and ALNA shall bear no liability arising from this circumstance. In the event of a modification, the CLIENT must inform ALNA by email or by calling the telephone numbers shown on our webpage.

Pursuant to article 21 of Law 34/2002 on the Information Society and eCommerce Services, we inform you that our business communications and information relating to our website and the products offered there will be carried out by email to the email address provided, which will be revocable. You have, in any event, the option of rejecting our business communications by sending an email info@poseidoncalella.com with the subject line UNSUBSCRIBE.

  1. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

The CLIENT acknowledges having read and accepted the legal conditions of use and privacy policy of the webpage.

The CLIENT acknowledges they have understood all the information regarding the products and services including, if applicable, those of delivery as presented on our webpage together with all the conditions and stipulations contained herein and attests that they are sufficient to exclude any error in consenting hereto and therefore expressly accepts same in full.

The CLIENT is fully aware that the acceptance and execution of this contract shall take place by providing their data and by pressing the “Purchase” button on our webpage and perfected by payment of the service.

  1. APPLICABLE LAW

This contract is commercial in nature and shall be governed and construed pursuant to Spanish law.

Should any type of discrepancy or dispute arise between the parties with regard to the interpretation, content or execution of this Agreement which is not resolved by mutual agreement, the Parties shall submit to the competent courts provided the user is a consumer (their domicile).

In those cases in which the parties may submit to a forum, they shall submit to the Courts of Bisbal del Ampurdán (Spain) and expressly waive any other to which they might have recourse.
